Judicial oversight of economic and social rights.

Abstract

The attention of statesmen, politicians, and the media focuses on political and civil rights, despite them being inherently individual rights, as these are the rights through which political activities are carried out and legislative, executive, and other positions in the state are held. Therefore, legislative, political, and media attention is concentrated on these rights because of the individual benefits they provide. The vast majority of statesmen, politicians, and media, however, overlook economic and social rights, which are described as collective rights and have a central importance essential for the implementation of individual rights. Economic and social rights are considered fundamental conditions for enjoying the inherent human dignity and exercising basic human rights; because economic and social rights encompass all activities of a collective nature, that is, those that do not pertain to the individual alone but include a group of people. These rights are considered the second generation of human rights, through which one can exercise the first generation representing civil and political rights. Economic and social rights entitle their holder to seek essential services from the state, especially with the emergence of these rights and their codification in international treaties.
