The Extent of Emphasis on Recidivism in Jordanian Law: A Comparative Study.

Abstract

The Jordanian legislator has stipulated reasons for aggravated punishment in the provisions of the Penal Code, in cases where it deems that the penalty prescribed for an act may not be appropriate considering the circumstances surrounding the occurrence of the crime, or considering the dangerousness of the offender's personality, and other circumstances that necessitate treating the offender with severity. The reasons for aggravating penalties in the Jordanian Penal Code appear in various forms depending on the perspective from which they are viewed, so they can be divided into personal aggravating factors and material aggravating factors, general aggravating factors and special aggravating factors. General aggravating factors occur when the legislator considers a reason for aggravation that applies to all crimes. Among the general aggravating factors adopted by the Jordanian legislator is 'recidivism.'
