Technological advancements in the world of communications and information have led to the emergence of a new virtual informational society that mirrors our real society in which we live. Although the Kuwaiti legislator has recognized the importance of keeping pace with this development, which prompted the amendment of the Civil Procedure Law to establish the principles of electronic judicial notification, it still lacks practical application, especially in international private disputes. This may be attributed to the ambiguity regarding the nature of judicial notification through electronic means and the circumstances in which it can be used as one of the most important newly introduced methods of judicial notification. It may also be due to the issues arising from the use of these modern electronic technologies in notifying foreign parties in lawsuits, their impact on litigation procedures, and the extent to which a third party, such as documentation authorities, can assist in implementing electronic judicial notification, all to achieve a mechanism that harmonizes modernity with technological development.
