The Scope of Legal Protection for Personal Data: A Comparative Study Between the European General Data Protection Regulation (GDPR) and the UAE and Kuwaiti Laws.

Abstract

This research was concerned with the legal scope of personal data protection, given that the protection of personal data is one of the current topics due to the tremendous technological development that has led to the growing risks arising from the use of this technology in terms of compromising the personal data of individuals, so special laws and regulations have been issued regulating the issue of personal data protection. This research examined the scope of personal data protection in the European General Regulation for the Protection of Personal Data No. 679 of 2016, the UAE Law No. 45 of 2021 on the Protection of Personal Data, and the Data Privacy Regulation No. 21 of 2021 issued by the Communications and Information Technology Commission of Kuwait, in order to know the extent and scope of legal protection covered by these laws and regulations, in terms of persons and subject matter. The research concluded that there was insufficient legal regulation on the protection of personal data in the United Arab Emirates and Kuwaiti legislation, since, unlike the Kuwaiti legislator who protects such data, the Emirati legislator does not protect the data of legal persons and data processed by the Government, The Kuwaiti legislature does not specify the nature and nature of sensitive biometric data or provide special protection for such data, as well as other findings and recommendations.
