The Substantive Provisions of the Crime of Begging in Iraqi Legislation (A Comparative Study).

Abstract

The crime of begging is considered a dangerous social phenomenon, although it varies from one country to another. It is deemed a deviation from the general social order due to its impact on public taste, the resulting degradation of citizen dignity, and the distress caused to the general public who are harassed by beggars. The painful sight of children, women, and the elderly begging also contributes to this perception. Although criminal networks or gangs are often behind these beggars, begging has become an increasingly serious problem. Despite its prevalence, there is a scarcity of mechanisms to address the crime of begging in national legislation, as if it is considered an accepted issue. For these reasons, and despite the many challenges involved, including the scarcity of sources addressing this crime and the difficulty of obtaining judicial rulings despite numerous inquiries due to the directive from the Supreme Judicial Council not to provide any person with a judicial decision except to those directly concerned, we chose to research this crime.
