In this study, I discussed the fate of the transfer contract of a professional athlete in light of the pandemic and the wars between force majeure and the theory of emergency circumstances. I clarified the concept of the sports transfer contract, the theory of force majeure, and the theory of emergency circumstances. I also addressed the effects of force majeure and the theory of emergency circumstances on the transfer contract. Whereas the transfer contract for a professional athlete is intended to be a contract concluded between this player and the old club, and at the same time, the athlete’s transfer contract concluded between the old club and the new club results in another new professional sports contract independent of the first professional sports contract concluded between the old club and the player. What is meant by the theory of emergency circumstances is every event subsequent to the formation of the contract that is not expected to occur during the contract, resulting in a disruption of the benefits generated by a contract whose implementation is delayed for a period or more, such that the debtor’s implementation of his obligation as required by the contract becomes extremely burdensome and threatens him with a heavy loss that goes beyond what is usual in the contract.
