Abstract

The research aims to study and analyze the position of the Emirati and Egyptian legislators in establishing a procedural system that guarantees the effectiveness of administrative control in marine environment crimes, by clarifying the most important means of administrative control in marine environment crimes, and reviewing the financial and non-financial administrative penalties for marine environment violations. The research relied on the analytical approach. The comparison between the Emirati and Egyptian law regarding environmental protection and development, and the research reached several results, the most important of which is that the texts of both the Emirati and Egyptian law regarding environmental protection do not clarify the tasks and duties of judicial officers with special jurisdiction regarding crimes and violations of pollution of the marine environment, which requires that all the powers assigned to them be withdrawn from them. Judicial officers with general jurisdiction stipulated in the Code of Criminal Procedure, and the research recommended the creation of specialized investigation bodies to look into marine environment crimes with the aim of quickly adjudicating them, provided that within their formation is an administrative control expert specializing in the marine environment.
