Abstract

The research branches out into several problems, the most important of which is that fair trial guarantees are essentially guarantees that apply to judicial procedures, and hence the question arises about the extent to which they apply to procedures for imposing a range of penalties imposed by an administrative authority and not a judicial authority; in addition, this research represents a point of intersection between administrative law and branches of public law and private law, as administrative law is linked in this context to constitutional law, as the constitution defines fair trial guarantees that apply to administrative penalties as they apply to criminal penalties, and administrative law intersects with criminal law, which provides strong guarantees related to criminal penalties that generally apply to administrative penalties, including penalties of the Financial Markets Regulatory Authority.Therefore, this chapter is divided into two sections as follows: The first section: Administrative penalties in the legislation regulating the Egyptian and French stock markets.
