Effect of the Appeal to Annul Severable Administrative Decisions to Invalidate Administrative Contracts.

The judgments of the French and Egyptian Council of State have long settled on the inadmissibility of the appeal of cancellation against management contracts. Some jurists have supported this trend, on which the judiciary has settled, while others have criticized the jurisprudence of refusing to accept the appeal of cancellation against the administration contracts and even demanding that the appeal of cancellation be accepted against the administration contracts. However; On 2 March 1982, France underwent a radical shift on the possibility of appeal against cancellation of administrative contracts. The legislator passed Act No. 213 of 1982 on the Rights and Freedoms of Local Bodies (Governor's Appeal). The Act permitted the representative of the State to appeal against decisions separate from contracts entered into by local bodies and to challenge cancellations against the same contracts entered into by local bodies. The reasons for this are due to the transitional period that this judiciary has undergone, after it has been permitted to appeal administrative decisions that can be separated from administrative contracts in order to avoid the idea of a parallel action. The Egyptian judiciary has adopted the idea of not arranging effects on administrative contracts if one of the decisions contributing to their formation is cancelled. However, it is pointed out from recent jurisprudence that there has been a change in this course so that it has arranged direct effects on the contract as a result of the cancellation of an administrative decision which contributed to the formation of the contract.
