Abstract
Complete justice has become a human right and even one of the most important human rights. There is no talk of security, stability, trade and investment. Except by ensuring justice between the litigants and in a way that achieves the rapid settlement of their disputes. A jurisprudential and legislative awakening has emerged that seeks to research, scrutinize, codify, and regulate simple, flexible mechanisms and rules that regulate litigation procedures and prevent their misuse, which leads to slow completion of them and procrastination in adopting them. These reform efforts have been based on Activating the function of the judge and his assistants; These ideas are of great importance in the field of administrative disputes. Therefore, it has become the focus of attention of the legislator, and of public law jurisprudence, precisely because administrative litigation is distinguished from its civil counterpart, in terms of the positive role of the judge in managing it and ending it before the judgment is completed. In fact, a distinguished group of agents, who are state commissioners, participate in this matter, as the commissioner plays two roles within the scope of administrative litigation. One is preparatory, and the other is final, through the settlement procedure between the two parties to the dispute, based on the legal principles upon which the Supreme Administrative Court’s rulings have been proven. This research comes to address this problem, which contributes to developing an integrated vision for it.
