In this study, we presented the topic of “Legislative regulation of the right of individuals to education: a study of the Kuwaiti and Egyptian constitution and legislation,” and in light of the rulings of the constitutional and administrative courts, and in order to highlight the legal importance of the subject of the study, we used the comparative descriptive analytical approach by describing and analyzing the legislation regulating the right of individuals. In education in both Egypt and Kuwait, as well as the opinions of jurisprudence and judicial rulings in this regard, with the aim of providing solutions to the legislator and the Kuwaiti judiciary to fill any gaps that may exist in legislation. We divided the study into two sections. In the first, we talked about the constitutional and legal enshrinement of the right of individuals to education in the Kuwaiti and Egyptian constitutions and legislation, and we explained the constitutional guarantees of the right of individuals to education. In the second, we discussed the role of the constitutional and administrative judiciary in protecting the right of individuals to education. As a tribute to the study, it concluded with a set of findings, the most important of which are: The Egyptian and Kuwaiti constitutions give special importance to education and learning. They worked to ensure and consecrate it, and the means of achieving and promoting it were left to the laws. The study concluded with a number of recommendations, the most important of which are: We call on the Kuwaiti constitutional legislator to add an article to the current constitution that enshrines the rights of people with special civil, political, social, cultural, and economic needs in general, and to guarantee their right to education in particular. Similar to what was stipulated in the Egyptian Constitution issued in 2014 in Article 81.
